Terms of Service

1. General Provisions

  • These terms define the conditions and procedures for using Gensio (hereinafter referred to as the "Service"), as well as the rights and obligations between the operator and users.
  • By using the Service, you are deemed to have agreed to these terms.
  • Any changes to these terms will be announced within the Service at least 7 days in advance. Continued use of the Service after changes constitutes acceptance of the revised terms.
  • The content and scope of the Service may change depending on operational circumstances. Important changes will be announced in advance.

2. Service Usage Rules

Users must not engage in the following activities:

  • Creating illegal content or content that violates public order and morals
  • Creating pornographic, violent, or hateful content
  • Infringing on the rights of others, including portrait rights, copyrights, and trademark rights
  • Interfering with the normal operation of the Service
  • Attempting reverse engineering, decompilation, or source code extraction of the Service
  • Mass access or data collection using automated means (bots, crawlers, etc.)
  • Unauthorized use or misappropriation of another person's account

Accounts may be restricted after prior warning for violations of these terms. In cases of serious violations, service access may be immediately suspended.

The Service may be temporarily suspended after prior notice for maintenance and improvement purposes.

3. Copyright and Intellectual Property Rights

  • Users are granted usage rights for images generated through the Service and may freely use them for both personal and commercial purposes.
  • The operator may anonymize and utilize user data for service quality improvement and statistical analysis purposes. In such cases, data is processed only in a form that cannot identify individuals.
  • Due to the nature of AI, similar outputs may be generated for other users, and exclusive rights to generated content are not guaranteed.
  • Users are responsible for verifying whether generated content infringes on the intellectual property rights of third parties.
  • Rights to the Service's UI, brand, and source code belong to the operator.

4. Payment and Refund Policy

  • Due to the nature of credits being used for digital content generation, refunds are generally not available.
  • Automatic Refund: If credits were deducted due to a technical failure but no image was generated, credits will be automatically restored.
  • Non-refundable: Refunds are not available for dissatisfaction with AI-generated results, credits consumed due to user error, or simple change of mind.
  • Changes to credit pricing will be announced 7 days in advance and will not affect credits already held.

Detailed Refund Policy

  • Refund Eligible: A full refund is available if no credits have been used within 7 days of purchase.
  • Non-refundable: Due to the nature of the AI image generation service, GPU computation costs are incurred immediately upon credit usage. Therefore, refunds are not available once credits have been used even once.
  • How to Request a Refund: Please send a refund request along with your order number to qodudgus0220@gmail.com. Requests will be processed within 3 business days.

5. Disclaimer and Limitation of Liability

  • The quality of AI-generated results varies depending on the prompt, source images, and other factors. A specific level of quality is not guaranteed.
  • Temporary service interruptions may occur due to maintenance or technical issues.
  • We are not responsible for service limitations caused by external API (Google, OpenAI) failures or policy changes.
  • The maximum liability of the operator is limited to the amount paid by the user within the most recent 3 months.
  • We do not compensate for indirect damages, lost profits, or data loss.
  • Users are responsible for any consequences arising from the use of generated content.

6. Third-Party Services

  • This Service utilizes Google OAuth (login), Google Gemini API, and OpenAI API.
  • The operator cannot control the impact of failures or policy changes of these services.
  • Users are also required to comply with the terms of service of these third-party services.

7. Account Withdrawal and Deletion

  • You may request account withdrawal by emailing qodudgus0220@gmail.com. Requests will be processed within 7 days.
  • Upon withdrawal, personal information and generated images will be deleted.
  • Unused credits will expire upon withdrawal and are not refundable.
  • Anonymized statistical data for service improvement may be retained even after withdrawal.

8. Indemnification

If a user violates these terms or a dispute arises with a third party due to the use of generated content, the user shall bear responsibility for any resulting damages to the operator.

9. General Provisions

  • Even if some provisions of these terms become invalid, the validity of the remaining provisions shall not be affected.
  • We are not responsible for service disruptions caused by force majeure events such as natural disasters or hacking.
  • These terms shall be interpreted in accordance with the laws of the Republic of Korea.
  • Disputes related to the use of the Service shall be under the jurisdiction of the Seoul Central District Court.
